Opt Out of Sale, Sharing, and Targeted Advertising

This notice supplements the Velvet Moon Privacy Policy and explains your rights regarding the sale or sharing of personal information and the use of personal data for targeted advertising. If this notice conflicts with our Privacy Policy regarding the rights described below, this notice will control to the extent of that conflict.

Velvet Moon ("Velvet Moon," "we," "us," or "our") may collect personal information when you visit, access, or use our website; purchase or review our products; create an account; subscribe to communications; contact us; or otherwise interact with Velvet Moon.

We may also collect information automatically through cookies, pixels, tags, software development kits (SDKs), local storage, log files, and similar technologies. This information may include device identifiers, browser information, IP address, approximate location, pages viewed, links selected, purchases, search activity, referral information, and interactions with advertisements or marketing communications.

Advertising and Third-Party Disclosures

Velvet Moon may disclose personal information to advertising networks, social media platforms, analytics providers, marketing providers, and other third parties for purposes such as:

  • Measuring and attributing advertising;

  • Understanding how visitors use our website;

  • Personalizing content and marketing;

  • Creating or using advertising audiences;

  • Preventing fraud and maintaining website security; and

  • Delivering advertisements based on activity over time and across websites, applications, devices, or services.

Depending on the law that applies where you live, some of these disclosures or processing activities may be considered:

  • A "sale" of personal information;

  • "Sharing" of personal information for cross-context behavioral advertising; or

  • Processing of personal data for "targeted advertising."

These activities may be treated as a sale or sharing under applicable law even when Velvet Moon does not receive monetary consideration in exchange for the personal information.

The use of these legal terms does not constitute an admission that Velvet Moon engages in a "sale," "sharing," or "targeted advertising" activity under every applicable privacy law.

Your Right to Opt Out

Where applicable law provides such a right, you may direct Velvet Moon to:

  • Stop selling your personal information;

  • Stop sharing your personal information for cross-context behavioral advertising; and

  • Stop processing your personal data for targeted advertising.

You may exercise these rights by using one of the following methods:

  1. Selecting the "Your Privacy Choices" or "Do Not Sell or Share My Personal Information" link available in the footer of our website;

  2. Adjusting your preferences through our Cookie and Privacy Settings;

  3. Submitting a request through our designated privacy request form; or

  4. Contacting us at info@velvetmoonus.com.

You do not need to create an account to submit an opt-out request unless account access is reasonably necessary to apply the request to information associated with that account and such a requirement is permitted by applicable law.

We may request only the information reasonably necessary to process your request, identify the information to which your request applies, prevent fraud, verify your identity where legally required, or comply with applicable law. Information provided for an opt-out request will be used solely for processing and documenting the request as permitted by law.

Scope of an Opt-Out Request

When we process an opt-out request, we will apply it to personal information associated with the browser, device, identifier, account, or consumer profile that we can reasonably identify from the request, to the extent required by applicable law.

An opt-out request does not necessarily prevent all collection, use, or disclosure of personal information. Velvet Moon may continue to collect, process, use, or disclose personal information where necessary to:

  • Operate, maintain, and secure our website and services;

  • Process transactions and fulfill orders you request;

  • Prevent fraud, abuse, unauthorized access, or other security incidents;

  • Maintain records of your privacy preferences;

  • Comply with legal obligations, regulatory requirements, or lawful requests; and

  • Engage service providers and processors acting solely on our behalf under legally compliant contractual restrictions.

After opting out, you may continue to receive advertisements. However, those advertisements should no longer be selected using personal information covered by your opt-out request.

Because certain privacy choices are associated with a specific browser or device, you may need to submit or enable your preference separately for each browser or device you use. Clearing cookies, changing browsers, reinstalling your browser, or using a different device may require you to renew your privacy preferences.

Global Privacy Control and Other Universal Opt-Out Preference Signals

Where required by applicable law, Velvet Moon recognizes and processes qualifying universal opt-out mechanisms and preference signals, including the Global Privacy Control ("GPC"), as valid requests to opt out of the sale or sharing of personal information and, where applicable, targeted advertising.

When Velvet Moon receives a qualifying signal, we will apply the opt-out request to:

  • The browser or device transmitting the signal;

  • Any pseudonymous or consumer profile associated with that browser or device; and

  • Your account or other identifiable consumer profile when the signal can reasonably be associated with your account, as required by applicable law.

When we cannot reasonably associate the browser or device transmitting the signal with your identity, account, or offline information, the signal may apply only to that browser, device, or associated profile.

A Global Privacy Control signal does not automatically submit unrelated privacy requests, including requests to access, correct, delete, or obtain a copy of your personal information. Those requests must be submitted separately using the methods described in our Privacy Policy.

Authorized Agents

Where permitted by applicable law, you may designate an authorized agent to submit an opt-out request on your behalf. Velvet Moon reserves the right to take reasonable steps, as permitted by law, to verify the identity and authority of any authorized agent before processing such a request.

No Unlawful Discrimination

Velvet Moon will not unlawfully discriminate against you for exercising any privacy rights available under applicable law. Exercising your privacy rights will not result in unlawful denial of products or services, different pricing, different quality of service, or any other discriminatory treatment prohibited by law.

Nothing in this notice limits Velvet Moon's ability to offer lawful financial incentive or loyalty programs that comply with applicable privacy laws.
